cannot open protected DBF file?

I am trying to open a DBF file created by another program but I keep getting the " Cannot Open Protected File" error on some of the files. The problem is that the file is created automatically from another DBF file daily and not all the files are doing this, seems to be random. I have checked the Attributes and the security settings but there is nothing different that I can see between ones that open fine and the ones that don't. Files start off as a Prox.dbf, a script runs daily and moves the file to a new location and renames it to Prox_Lab7_date.dbf and this occurs just about everyday but for some reason some of them don't work when opened in excel. I can open the files fine in wordpad but it seems to just make excel cry.

I have attached an example of a working and a non-working file but I had to change the .dbf to .txt to get the uploader to take them, so if you download the files change them to .dbf extensions before you try to open them. I also tried to get ones that were about the same size so that I know its not a size or name issue.
