Manipulating Charts Without Activate or Select

Hi all, I am a little burnt out right now so my mind can not come up with a possible solution to removing selects and activates. I have this:

This returns a Run Time error 438. How can I go about maniputlating the chart without activating it? I've tried a range of different ways including:

and I cannot get this to work. I really want to clean up my code for my project and get rid of select statments if possible. Any ideas?
