Spell Check greyed out [when sheet is protected]

Spell check is disabled on protected sheets, regardless of whether there are unlocked cells. The only way to do this is a custom VBA solution which will temporarily unprotect the sheet, do the spellcheck on unlocked cells, and re-protect the sheet.
