Have you thought about trying name ranges for your Data Validation list, that way you can put your name range list anywhere in your workbook.
I have attached a sample workbook, if that may help.

Thank you but the problem is that I use the workbook to delete rows when complete but when they do that the remove the lists hence I though to put the list in code some how?
The idea is to put the list in a sheet that is not used.
