Duplication issue when filtering unique records

Whenever I use the Advanced Filter to extract the individual records into another column (Advanced Filter, Copy to another Location, Unique records only), the first record is always duplicated:

Original list Filtered List
1 1
2 2
3 3
1 1
2 4
3
4

As you can see "1" is duplicated - how can I stop this from happening?

I think the 1 in this case is the header, try inserting a header row before you Auto-filter.
